Pink Panther Power (hereinafter also referred to as ‘we’, ‘us’, ‘us’ or ‘our’) is committed to protecting your personal data. Personal data obtained from the sale of our products will be processed in accordance with applicable privacy regulations and will only be used in the manner described in this privacy statement

Pink Panther Power processes personal data and is bound by the privacy rules set out in the General Data Protection Regulation (GDPR’). If you are a data subject (e.g. a customer), we encourage you to read this privacy notice carefully.

1. Why does Pink Panther Power have this privacy notice?

In this privacy statement, we explain as clearly as possible which personal data we process, for what purpose and on what legal basis. In doing so, Pink Panther Power implements the information obligation laid down in the GDPR to the data subject(s) whose personal data Pink Panther Power processes

2. What is personal data and what is processing?

Personal data is any data that allows a natural person (the ‘data subject’) to be identified. Processing personal data is the performance of actions with a data subject’s personal data, such as receiving, storing, modifying, transmitting and deleting that personal data. We process your personal data when you purchase our products.

3. What personal data do we process?

The personal data we may process from you are:

• basic information such as your first and last name;

• contact details such as your address, (mobile) phone number and e-mail address;

• technical data, such as your IP address, the device you use to visit our website and the pages you view;

We try not to collect more personal data than we need. 

4. How do we obtain your personal data?

In almost all cases, we will obtain your personal data from you, for example, if you:

– visit our website (www.pinkpantherpower.com, hereinafter our “Website“);

– makes an order via our Website;

– fill in a form on our Website, such as to subscribe to our newsletter; 

– apply to us; 

– tell you personal information during (telephone) conversations, e-mail contact with us or take part in surveys;

– are a representative of our business relation(s) and/or (potential) customer(s);

– are a (former) employee;

5. For what purpose (and under what basis) do we process your personal data?

Processing personal data is to offer our customers our service and, in doing so, to provide them with the best possible experience. We may only process your personal data if there is a ‘legal basis’ for doing so. Below, for each purpose (of processing), the basis (from Art. 6 of the GDPR) on which it takes place is also described. We process your personal data for the purposes listed below:

• For processing your order and performing our service

To ensure that our products are delivered to the correct address and to the correct addressee, it is necessary for you to provide Pink Panther Power with your personal data. We then process this personal data for the following purposes:

– to (have) your order processed and delivered;

– to manage the payment of your order. Please note that payment data (credit card number and/or bank account details) are not processed by us but directly by the payment service providers, such as iDeal, Mollie or Klarna. For how these companies handle your personal data, please consult the privacy statement of the relevant payment company;

The basis for this is the performance of the agreement you have with Pink Panther Power. 

• For sending our newsletter and/or other commercial messages

Pink Panther Power may also use your personal data for direct marketing and communication purposes. For example, to send you messages about offers from Pink Panther Power or its affiliates that are relevant to you. 

The processing in this case takes place on the basis of a legitimate interest. In case you are not a customer, but have indicated on the Website that you wish to receive our newsletter/marketing, the basis is the consent given by you to receive the newsletter. This consent can be revoked at any time by, for example, unsubscribing via the link in the newsletter

• For improving and analysing our Website

Some personal data (obtained through cookies) is processed by Pink Panther Power to monitor and improve the Website, collect statistics and secure the Website. These processing operations take place on the basis of a legitimate interest so that the Website works well and can continue to improve. If tracking cookies are involved, prior consent is requested via the cookie banner. Then processing takes place on the basis of informed consent. If you do not want the cookies, you can adjust your browser settings.

A cookie is a small text file that is placed on your computer’s hard disk when you visit the Website. It allows us to collect data such as your IP address, preferences and surfing behaviour

6. With whom do we share personal data?

We will not share your personal data with third parties for commercial purposes without your prior consent. However, we may need to share your personal data with third parties for other reasons. This may be in cases such as those listed below:

• for processing payments, including iDeal;

• for processing postal shipments, with PostNL, among others;

• for managing our newsletter, using (currently) ChimpMail;

• to meet any legal obligations.

In the above cases, these third parties are processors and we only provide them with the data they need to perform the service. They may therefore not use your personal data for other (their own) purposes. 

Third parties to whom we provide your personal data are themselves also responsible for the processing of that data and for compliance with the GDPR.  If any of our external service providers process personal data outside the European Economic Area, our written agreement with them will include appropriate measures, usually standard contractual clauses. For the treatment of personal data of these external parties, please see their privacy statement. 

7. How long do we keep personal data?

Discretion and privacy are very important to us. We therefore do not keep your personal data in a traceable form for longer than is necessary for the purpose for which we have processed it. If there is a legal retention obligation (such as that of records of 7 years), we adhere to these periods. In that case, the personal data will be properly destroyed after the retention obligation, unless another specific legal basis requires us to retain your data for longer anyway.

8. How are personal data secured?

We have taken appropriate technical and organisational measures to counter abuse, loss, unauthorised access, unwanted disclosure and unauthorised modification of your personal data. 

These measures include (but are not limited to):

– secure network connections (SSL);

– storage of personal data in a secure digital cloud environment;

– access to personal data is restricted with passwords and to certain authorised persons;

– up-to-date backups;

– firewalls;

– virus scanners;

– software updates;

9. Does this privacy statement also apply to linked sites?

This privacy statement does not apply to third-party websites linked to our Website. We cannot guarantee that these websites will handle your personal data in a reliable or secure manner. Before using the relevant website, always read the privacy statement of that website for more information on how they handle your data.

10. What are your rights?

You have the following privacy rights:

– the right to see your personal data;

– the right to amend your personal data;

– the right to have your personal data deleted;

– the right to request a data export of your personal data;

– the right to request correction or completion of your personal data (motivated);

– the right to object to the processing of your personal data (reasoned).

You can send a request via email to info@pinkpantherpower.com. In your request you must state the reason for your request. We will then process your request within four weeks.

Before we can honour your request, we do need to verify your identity. After all, we want to avoid giving someone access to someone else’s personal data. We do this using so-called two-factor authentication, based on the personal data we may still have on you. Examples include confirmation of your request by text message via the telephone number known to us or you answering certain verification questions. 

You also have the right to submit any questions/complaints to the regulator (the Personal Data Authority).
